BEATIT TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using BeAtIt (the "Service," "Platform," "App," or "BeAtIt"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Service.

BeAtIt is operated by BeAtIt ("we," "us," or "our"), a company registered in North Macedonia.

2. DESCRIPTION OF SERVICE

BeAtIt is a nightlife discovery platform that provides:

• Event Discovery: Browse and discover nightlife events, concerts, and experiences
• Venue Information: Access information about venues, clubs, bars, and entertainment spaces
• Personalized Recommendations: Receive tailored suggestions based on your music preferences and venue interests
• Map Features: View events and venues on an interactive map with optional location-based search
• Social Features: Follow artists, organizations, and venues; save favorites; rate venues
• User Profiles: Create and customize your profile to connect with the nightlife community

Important: BeAtIt is an information platform only. We do not sell tickets, process payments, or organize events. We provide information and may link to third-party ticketing platforms.

3. USER ACCOUNTS AND REGISTRATION

3.1 Account Types

BeAtIt operates with three user account types:

a) Public Users (Standard Accounts)

• Default registration type for all new users
• Access to browse events, venues, artists, and organizations
• Ability to save favorites, follow users, rate venues, and interact with content
• Limited to consumer features only
• No dashboard access for posting events or managing venue profiles

b) Verified Venues

• Business accounts for venue owners and operators
• Ability to manage venue profiles, post events, and update information
• Requires verification and approval
• Must contact contact@be-at-it.com with business documentation

c) Verified Artists/Organizations

• Accounts for performers, DJs, promoters, and event organizations
• Ability to manage artist profiles, showcase work, and promote events
• Requires verification and approval
• Must contact contact@be-at-it.com with professional credentials

3.2 Registration Requirements

When you register for BeAtIt, you agree to:

• Provide accurate, current, and complete information including:
  • First name and last name
  • Valid email address
  • Secure password (minimum 8 characters)
• Complete email verification before accessing the platform
• Select minimum 3 music genre preferences (required for personalized recommendations)
• Select minimum 2 venue type preferences (required for personalized recommendations)
• Maintain and update your information to keep it accurate and current
• Be responsible for safeguarding your password and account security
• Accept that your profile and activity may be visible to other users based on your privacy settings

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your email address remains valid and accessible

4.1 Data We Collect

By using BeAtIt, you consent to our collection and use of the following personal information:

Profile Information:

• Name (first and last)
• Email address
• Phone number (optional)
• Profile picture/avatar
• Username
• Bio/description
• City and country of origin
• Artist tag (for artists)

Preference Data:

• Music genre preferences (min 3 genres required during signup)
• Venue type preferences (min 2 types required during signup)
• Artist music genres (for artist accounts)

Social Media Links (Optional):

• Instagram profile and video links
• Facebook profile and video links
• SoundCloud profile and track links
• Spotify profile and track links
• YouTube profile and video links
• Website links

Activity Data:

• Events you mark as "interested" or "going"
• Venues you favorite and save
• Venue ratings and reviews you submit
• Artists and organizations you follow
• Search history and browsing patterns
• User interactions and engagement metrics

Location Data (Optional):

• GPS coordinates when you use "Near Me" map features
• City/location for event and venue recommendations
• Proximity search radius preferences

Technical Data:

• Device type and operating system
• Device identifiers
• App usage patterns and analytics
• IP address
• Session information

4.2 How We Use Your Data

We use your personal data to:

• Provide personalized recommendations for events, venues, and artists based on your preferences. We use your personalized data (music genres and venue types you selected) solely to show you relevant entities within the BeAtIt application. We do not use this data for advertising, third-party marketing, or any other commercial purposes outside of providing you with relevant content within our application.
• Enable social features including following, favorites, and user interactions
• Display relevant content based on your location (when you opt-in to location services)
• Improve our service through analytics and user behavior insights
• Send notifications about events, updates, and recommendations (with your consent)
• Ensure platform safety and prevent fraud, abuse, and unauthorized access
• Communicate with you about your account, service updates, and support requests
• Comply with legal obligations and enforce our Terms

Important: Your personalized preferences are used exclusively to filter and display relevant content within the BeAtIt App. We do not share, sell, or use this personalized data for advertising, third-party marketing, or any other commercial purposes outside of providing you with relevant content within our application.

4.3 Data Sharing

We do not sell your personal data. We may share your data with:

• Third-party service providers who assist in operating our platform (hosting, analytics, email services)
• Event organizers and venues when you mark interest in their events or interact with their content
• Other users based on your privacy settings (public profile information, activity)
• Legal authorities when required by law or to protect our rights

4.4 Your GDPR Rights (EU Data Protection)

If you are located in the European Union or European Economic Area, you have the following rights under GDPR:

• Right to Access: Request a copy of all personal data we hold about you

• Anonymized and aggregated data may be retained indefinitely for analytics

4.6 Location Data Privacy

Location access is entirely optional and controlled by you:

• We request location permission only when you use map features
• You can deny location access and still use all other features
• Location data is used only for "Near Me" searches and proximity-based recommendations
• You can disable location access at any time in your device settings
• We do not track your location in the background

5. USER CONTENT AND CONDUCT

5.1 User-Generated Content

You may post, upload, or share content on BeAtIt including:

• Profile information and photos
• Venue ratings and reviews
• Comments and interactions
• Social media links

By posting content, you agree that:

• You own or have rights to the content you post
• You grant BeAtIt a license to use, display, reproduce, and distribute your content on the platform
• Your content will not:
  • Violate any laws or infringe on others' rights
  • Contain harmful, offensive, discriminatory, or inappropriate material
  • Include false, misleading, or defamatory information
  • Contain spam, advertising, or promotional content (unless you're a verified venue/artist)
  • Impersonate others or misrepresent your identity

5.2 Content Moderation

BeAtIt reserves the right to:

• Review, moderate, edit, or remove any user content
• Suspend or terminate accounts that violate these Terms
• Remove content that violates our community guidelines
• Take action against abusive or harmful behavior

5.3 Prohibited Activities

You agree NOT to:

• Create fake accounts or impersonate others
• Engage in spamming, harassment, or abusive behavior
• Share false or misleading information about events, venues, or users
• Attempt to breach security, hack, or access unauthorized areas
• Use automated tools (bots, scrapers) to access the platform
• Collect or harvest user data without permission
• Interfere with the proper functioning of the Service
• Use the Service for any illegal purposes

5.4 Ratings and Reviews

When rating venues or posting reviews:

• Be honest and base reviews on your actual experience
• Do not post fake, malicious, or misleading reviews
• Respect others' opinions and experiences
• Avoid offensive, discriminatory, or inappropriate language
• Do not use reviews for personal attacks or harassment

We reserve the right to remove reviews that violate these guidelines.

6. EVENTS, VENUES, AND THIRD-PARTY CONTENT

6.1 Information Accuracy

BeAtIt provides information about events and venues but is not responsible for:

• Accuracy of event details, dates, times, or venue information
• Event cancellations, postponements, or changes
• Quality of venues, events, or services provided by third parties
• Availability of tickets or entry to events
• Pricing, ticket sales, or refund policies

Event and venue information is provided by:

• Verified venue accounts
• Verified artist/organization accounts
• BeAtIt administrators

We strive for accuracy but cannot guarantee all information is current or correct.

6.2 Third-Party Ticketing and Links

BeAtIt may provide links to third-party ticketing platforms or event websites. We do not:

• Process payments or sell tickets directly
• Control third-party websites or services
• Guarantee the security or reliability of third-party platforms
• Assume liability for third-party transactions or services

When you click external links or purchase tickets through third-party platforms:

• You are subject to their terms and conditions
• You enter into a direct relationship with that third party
• BeAtIt is not responsible for any issues, disputes, or problems

6.3 Your Safety and Experience

BeAtIt is not responsible for:

• Your safety or experience at events or venues
• Incidents, accidents, or injuries that occur at events
• Disputes with event organizers, venues, or other attendees
• Loss or theft of personal property
• Quality of food, drinks, or services at venues

You attend events and visit venues at your own risk.

We recommend:

• Researching events and venues before attending
• Following local laws and venue rules
• Drinking responsibly and arranging safe transportation
• Being aware of your surroundings and personal safety

7. INTELLECTUAL PROPERTY

7.1 BeAtIt's Intellectual Property

All content, features, and functionality of BeAtIt are owned by us and protected by:

• Copyright laws
• Trademark laws
• Other intellectual property rights

This includes:

• The BeAtIt name, logo, and branding
• App design, layout, and user interface
• Software code and algorithms
• Original content created by BeAtIt

You may not:

• Reproduce, distribute, or create derivative works without our written permission
• Use our trademarks or branding without authorization
• Reverse engineer or decompile the app
• Copy or scrape content from the platform

7.2 User Content License

By posting content on BeAtIt, you grant us a:

• Non-exclusive, worldwide, royalty-free license
• To use, display, reproduce, modify, and distribute your content
• For the purpose of operating and promoting the Service
• This license continues even if you delete your content or account (for cached or backup copies)

You retain ownership of your content.

8. AGE REQUIREMENTS

BeAtIt requires users to be at least 16 years old to use our Service.

By creating a BeAtIt account, you confirm that:

• You are at least 16 years old
• You have accurately and truthfully represented your age during registration
• You take full responsibility for ensuring you meet the age requirement

User Responsibility:

• Users are solely responsible for ensuring they meet the age requirement of 16 years or older
• BeAtIt relies on users' truthful representation of their age during registration
• We are not responsible for verifying the actual age of users, and users assume all responsibility for age eligibility compliance

Age Verification:

We reserve the right to verify your age at any time and may request additional documentation (such as government-issued ID). However, we are not obligated to actively verify every user's age. Our reliance on users' truthful age representation does not constitute active age verification.

If Age Misrepresentation is Discovered:

If we discover you have misrepresented your age, we will:

• Terminate your account immediately
• Delete your personal information in accordance with our data retention policies
• Report the violation to relevant authorities if we suspect fraudulent activity or if required by law

Limitation of Liability for Age Misrepresentation:

BeAtIt is not liable for users who misrepresent their age. Users agree to indemnify and hold harmless BeAtIt, its officers, directors, employees, and partners from any claims, damages, losses, legal consequences, or regulatory actions arising from age misrepresentation or unauthorized use of the Service.

9. SERVICE AVAILABILITY AND MODIFICATIONS

9.1 Service Availability

We strive to keep BeAtIt available 24/7, but we do not guarantee uninterrupted service.

We may temporarily suspend the Service for:

• Scheduled maintenance and updates
• Emergency repairs
• Technical issues or outages
• Security concerns

9.2 Modifications to the Service

We reserve the right to:

• Modify, update, or discontinue features at any time
• Change the Service's functionality or appearance
• Add or remove content, events, or venues
• Update these Terms and Conditions

We will notify you of significant changes via email or in-app notification.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

BeAtIt is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We are NOT LIABLE for:

• Any damages resulting from your use of the Service
• Attendance at events or visits to venues discovered through our platform
• Loss of data, profits, or business opportunities
• Indirect, incidental, consequential, or punitive damages
• Issues with third-party services, ticketing platforms, or websites
• Inaccurate event or venue information
• Service interruptions, errors, or technical issues
• User-generated content or actions of other users

Your use of BeAtIt is at your own risk.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BeAtIt, its officers, directors, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you post or share on the platform
• Your attendance at events or visits to venues

12. ACCOUNT TERMINATION

12.1 Termination by BeAtIt

We reserve the right to suspend or terminate your account:

• If you violate these Terms and Conditions
• If you engage in prohibited activities or abusive behavior
• If we suspect fraudulent or illegal activity
• If required by law or legal authorities
• At our sole discretion for any reason

12.2 Termination by You

You may delete your account at any time by:

• Contacting us at contact@be-at-it.com
• Using in-app account deletion features (if available)

Upon termination:

• Your access to the Service will be revoked immediately
• Your personal data will be deleted immediately (subject to legal retention requirements)
• Some content may remain in cached or backup copies

13. DISPUTE RESOLUTION

13.1 Informal Resolution

Before filing any legal claim, you agree to:

• Contact us at contact@be-at-it.com to resolve the dispute informally
• Provide a detailed description of the issue
• Allow us 30 days to respond and attempt resolution

13.2 Governing Law

These Terms are governed by the laws of North Macedonia.

Any disputes arising from these Terms or your use of BeAtIt shall be resolved in the courts of North Macedonia.

13.3 Arbitration (Optional)

For disputes that cannot be resolved informally, both parties may agree to binding arbitration in North Macedonia under mutually agreed arbitration rules.

14. INTERNATIONAL USERS

BeAtIt is operated from North Macedonia but accessible worldwide.

If you access the Service from outside North Macedonia:

• You are responsible for compliance with local laws
• Your data may be transferred to and processed in North Macedonia
• You consent to the transfer and processing of your data as described in these Terms

15. CHANGES TO THESE TERMS

We may update these Terms and Conditions periodically to reflect:

• Changes in our Service or features
• Legal or regulatory requirements
• Improvements to user protection

We will notify you of significant changes via:

• Email to your registered email address
• In-app notification
• Notice on our website

Continued use of BeAtIt after changes constitutes acceptance of the new Terms.

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and BeAtIt regarding your use of the Service.

19. NO WAIVER

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

20. ASSIGNMENT

You may not assign or transfer your rights under these Terms without our written consent.

We may assign our rights and obligations under these Terms to any successor or affiliate without your consent.
